Kalkonu Travel Terms and Conditions

General Terms and Conditions (as of 01.03.2022)

Preamble

All FIT (individual travel) offers are valid indefinitely until revoked. We reserve the right to make price adjustments if the booking is made more than 2 weeks after the offer was made, if service providers have made price changes, if there are significant exchange rate fluctuations or if the state imposes taxes. All services are subject to availability until a binding reservation is made.

With your booking order by email, you make a binding offer to the travel provider Kalkonu Travel to conclude the travel contract. As soon as we have received your booking order, we will make all reservations for the services offered. The contractual relationship becomes binding for the travel provider Kalkonu Travel when it confirms the booking and the price in writing by email in the form of a booking confirmation. It normally takes 3 to 5 working days for all service providers to confirm the reservations and for Kalkonu Travel to then send you the booking confirmation. With the booking confirmation, the customer also receives the final travel information and vouchers (service vouchers).

Our tours are always carried out in accordance with the description in our program. We reserve the right to make changes to itineraries, program schedule or accommodation. Late arrival at the scheduled departure times or times at which a tour starts, as a result of which a participant is left behind, excludes claims for compensation of any kind.

 

1. Payment of the tour price

1.1 Unless a different payment date has been agreed in individual cases, payment must be made to Kalkonu Travel's account within 30 days of receipt of the booking confirmation, with 25% of the tour price paid in advance and the balance paid by 30 days before the start of the tour.

1.2 If the traveler's booking declaration is submitted less than 30 working days before the start of the trip, the

entire travel price is due for payment immediately.

If the outstanding amount is not received by 21 days prior to arrival despite a further request for payment, this shall be deemed.

This shall be deemed to be an unannounced cancellation of the trip by the customer and shall be subject to the corresponding cancellation fees.

 

2. Changes to services and prices

2.1 Changes to and deviations of individual travel services from the agreed content of the travel contract are permissible if they become necessary after the contract has been concluded, are not caused by the organizer in breach of good faith and do not otherwise affect the overall nature of the trip. This applies in particular if official measures in the country visited necessitate changes to the itinerary.

2.2 Significant changes to services as a result of extraordinary circumstances unforeseeable at the time of conclusion of the contract for which KALKONU TRAVEL is not responsible, in particular in cases of force majeure (including natural events such as volcanic eruptions, earthquakes, floods, etc.), are also permitted, provided that the changes are reasonable for the customer, taking into account the interests of the tour operator.

2.3 All prices are quoted in US dollars. The price and the services of the tour operator Kalkonu Travel for your individually booked travel package are shown in the offer and are binding once the deposit has been paid. Should there be any changes in the cost price before the trip through no fault of our own (exchange rates or price increases by hotels, service providers, taxes, etc.), we reserve the right to adjust the price.

 

3. withdrawal by the customer, rebooking, replacement persons

3.1 The customer may withdraw from the tour at any time before the start of the tour. Decisive is the receipt of the declaration of withdrawal by the tour operator within his office hours on working days (Monday to Friday) from 07:00 to 16:00 local time Costa Rica. The customer is advised to declare the withdrawal in writing (by email)

3.2 If the customer makes use of his right of withdrawal, KALKONU TRAVEL can demand a lump-sum compensation. The amount of the lump-sum compensation is calculated from the tour price and the time of receipt of the declaration of withdrawal by KALKONU TRAVEL as follows:

 

Individual trips:

  • up to 30 days before the start of the trip 25%
  • from day 29 to day 22 before the start of the trip 45
  • from day 21 to day 15 before the start of the trip 60%
  • from day 14 to day 7 before the start of the trip 85
  • from day 6 to the start of the trip 95 %
  • of the respective total travel price.

 

Booked trips/group trips from the annual program

  • 25 % up to 30 days before the start of the trip              
  • from the 29th to the 22nd day before departure 45% of the tour price;
  • from 21-15 days before departure 60% of the tour price;
  • from the 14th to the 7th day before departure 85% of the tour price;
  • from the 06th day before departure until the day of departure, no-show 95% of the tour price;
  • per person of the respective total travel price.

The cancellation rate refers to the cancellation of one person, a couple or a family on a group trip and not to the cancellation of the entire group.

 

Cancellation of individual places for special groups or private groups:

  • up to 33 days before departure 25% of the tour price
  • from the 32nd to the 22nd day before departure 45% of the tour price;
  • from 21-15 days before departure 60% of the tour price;
  • from the 14th to the 7th day before departure 85% of the tour price;
  • from the 06th day before departure until the day of departure, no-show 95% of the tour price;
  • per person of the respective total travel price.

 

If the cancellation rate for individual persons on a special group tour is less than 85%, the group may be moved to a different price scale according to the number of guests still traveling. A new calculation would then have to be made and the difference invoiced accordingly.

If an entire group cancels after receiving the last room list or fixed booking before departure, the cancellation rate is 95%.

Cancellation conditions may vary depending on the hotel category; hotels in the luxury class in particular may have significantly stricter cancellation conditions. If a hotel has different cancellation conditions, these are then valid in deviation from the travel conditions or the flat-rate cancellation scale.

Deposits paid will be refunded after deduction of the remaining cancellation costs or, in the event of a negative balance, a final payment will be required.

 

3.3 If the participant does not make use of individual travel services due to premature return due to illness or for other reasons for which KALKONU TRAVEL is not responsible, the participant is not entitled to a pro rata refund.

3.4 If, at the customer's request, changes are made to the travel date or accommodation after booking (rebooking) or if the customer is replaced by a third party during the tour, KALKONU TRAVEL may charge a rebooking fee of USD 25 per tour. Customer rebooking requests made less than four weeks before departure can only be carried out, if at all possible, after withdrawal from the travel contract in accordance with Sections 5.1. and 5.2. and simultaneous re-registration. This does not apply to rebooking requests that only incur minor costs. Any costs incurred as a result of the rebooking will be charged to the customer in addition to the rebooking fee. KALKONU TRAVEL may object to the participation of a substitute person if this person does not meet the special travel requirements, if the local service providers prohibit a change of name or if legal or official regulations of the country of origin or destination prevent their participation.

 

4 Cancellation and termination by the tour operator

4.1 Charter flights are subject to traffic rights granted at short notice by the authorities of the destination countries. The granting of the respective season is not known when the offer is made. In the event of non-approval or revocation, the tour operator may therefore withdraw from the travel contract.

4.2 KALKONU TRAVEL may withdraw from the contract up to 28 days before departure if the minimum number of participants stated in the travel advertisement or set by the authorities is not reached.

4.3 KALKONU TRAVEL is obliged to inform the customer of a permissible travel cancellation or a significant change to an essential travel service immediately after becoming aware of this.

4.4 KALKONU TRAVEL may withdraw from the contract if the customer does not pay the travel price due within the grace period set, despite a warning of withdrawal. In the event of withdrawal due to late payment, KALKONU TRAVEL may demand compensation in accordance with the flat rates stated in section 3.

4.5 After commencement of the trip, KALKONU TRAVEL may terminate the contract if the customer persistently disrupts or jeopardizes the performance of the trip despite a warning from the tour operator. The nature and requirements of the trip and the interests of the tour group must be taken into account.

In the event of termination after the start of the tour, the tour operator shall be represented by the respective tour guide. Cancellation is limited to that part of the tour whose performance is impaired or disrupted by the customer's behavior. Any additional costs incurred as a result shall be borne by the customer. If the tour operator terminates the contract, it retains the right to the tour price; however, it must allow the value of the expenses saved to be offset.

 

5. force majeure

If the trip is significantly impeded, endangered or impaired as a result of force majeure unforeseeable at the time the contract was concluded (unexpected, extraordinary and unavoidable events such as war, strikes, road closures, natural events such as earthquakes, forest fires, volcanic eruptions, storms, floods, pandemics, etc.), both the organizer and the traveler may terminate the contract. In the event of termination due to circumstances of force majeure, the traveler is obliged to bear the additional costs for repatriation or quarantine, the costs of cancellations or booking changes.

In the event of foreseeable force majeure, such as the consequences of the corona pandemic, the traveler bears the risk of travel cancellations, travel warnings, restrictions on site, treatment costs in the event of necessary medical treatment, quarantine and cancellation of services.

If the trip cannot be taken due to the pandemic because of official orders, we will try to rebook the trip to a later date free of charge for you. Only tariff increases for other seasons or tax increases may apply.

Long-term consequences of the COVID-19 pandemic, such as bankruptcy of service providers, are unfortunately consequences that we cannot influence, for this reason there may be changes to services at any time. Should a service provider unexpectedly become unavailable, we will look for a service provider of the same standard. If there are any differences in rates, these will either be credited or charged.

 

6. Liability

KALKONU TRAVEL is liable within the framework of Costa Rican law. KALKONU TRAVEL is liable up to a maximum amount of 500,000 US dollars for claims for damages by the customer due to injury to life, body or health, such as claims for damages based on a grossly negligent breach of duty by KALKONU TRAVEL. The limitation period is 1 year and begins on the day on which the trip should end according to the travel contract.

 

7. Warranty periods

Claims of the customer due to travel defects must be reported immediately upon occurrence on site in order to be able to provide remedy. The customer must grant KALKONU TRAVEL a reasonable period of time to remedy the situation. Claims due to failure to take remedial action or continuing defects can be asserted by email up to 14 days after the end of the trip.

 

8. insurance

The advertised travel price does not include travel insurance (e.g. for travel cancellation costs, health insurance, etc.). We generally recommend that you take out travel insurance.

 

9. Passport, visa, customs, foreign exchange, vaccination, and health regulations

9.1 The customer is responsible for complying with all regulations that are important for the execution of the trip. All disadvantages arising from non-compliance with these regulations shall be borne by the customer, unless they are due to culpable misinformation on the part of the tour operator. The tour operator may pass on to the customer information about passport, visa, customs, foreign exchange, vaccination and health regulations of which it is aware, but shall not be liable for their accuracy. Costs for vaccinations are not included in the price and must be borne by the customer.

9.2 The customer must ensure that their passport or identity card and other travel documents are sufficiently valid.

 

10. Contractual obligations, assertion of claims, prohibition of assignment, place of jurisdiction

10.1 The traveler must notify KALKONU TRAVEL immediately of any defects occurring during the trip. The customer will receive all contacts (including emergency number) of KALKONU TRAVEL with the last travel documents. The traveler must grant the agency a reasonable period of time to remedy the situation.

10.2 Costa Rican law applies. The place of fulfillment for all reciprocal claims arising from the travel contract, in particular payment claims, is Ciudad Colón/Costa Rica

10.3 The assignment of any claims of the customer arising from the trip, regardless of the legal grounds, to third parties, including spouses, is excluded. Equally excluded is their assertion in court in their own name.

10.4 San José, Costa Rica, is agreed as the place of jurisdiction, insofar as this is legally permissible.

 

11. Invalidity of individual provisions

The ineffectiveness of individual provisions does not justify the ineffectiveness of the rest of the travel contract.
