COVID-19 TERMS and CONDITIONS
These terms and conditions will be updated regularly and remain in place as an addition to our standard terms and conditions (refer below). They are valid until such time the World Health Organisation declares the pandemic over and relevant travel restrictions (outbound and for countries within which AE operates) are lifted, after which only our standard terms and conditions apply.
Anderson Expeditions (AE) is subject to the specific terms and conditions of each operator but endeavors to extend, in consultation with our partners, the following terms to our clients:
- Current confirmed bookings can only be cancelled or postponed 6 weeks prior to the original date of travel
- Should guests elect to cancel their booking, then AE standard terms and conditions will apply
- Should guests wish to postpone their booking they can do so to a new date within 12 months of the original travel date – details are to be communicated directly to each client and relating specifically to their itinerary:
- The full booking value and credit for payments already received by AE will be carried forward to the new dates (*)
- Original rates will be honoured for new travel dates within 2020 (*)
- If the booking is postponed for travel in 2021 the traveler will be liable for cost increases on accommodation, services, logistics, activities etc. as a result of annual or seasonal or other rate changes
- AE will manage a postponed booking on behalf of the client free of charge on the first dates change. Subsequent dates changes will be charged at a fee of 10% on the total booking value.
- All new bookings confirmed with AE up until 1st July 2020 will be subject to the same terms above.
* Subject to property, operator or government/regulatory bodies – i.e. parks or permits – not matching our terms.
We continue to engage with our partners to align with the Covid-19 Anderson Expeditions Terms and Conditions, and to work in our clients best interests as far as possible.
STANDARD TERMS AND CONDITIONS
1. DEFINITIONS - Anderson Expeditions CC 2007/023916/23 is hereinafter referred to as " Anderson Expeditions " and the person who accepts the booking by payment is hereinafter referred to as the "CLIENT". This booking and subsequent contract between the client and Anderson Expeditions shall be deemed to be concluded in the Republic of South Africa, subject to the terms and conditions reflected herein.
2. BOOKING - (a) Please note that reservations cannot be made without a deposit and provisional bookings are not guaranteed prior to the suppliers receiving the required deposit payments. (b) The balance of the fare is due EIGHT (8) weeks prior to the date of departure.
3. DEPOSITS - A deposit of 30% on accommodation and services, and the full cost on flights is required when confirming the booking. The deposit is non-refundable – please refer below.
4. CANCELLATIONS - Cancellation of bookings by the client must be made in writing and is effective from the date it is received by Anderson Expeditions. The following cancellation fees will be payable by the client:
> 60 days = deposit only
< 60 days = 100% of total fare
Should a client fail to start an expedition, join late or fail to complete an expedition, no refund shall be made or liability be accepted by Anderson Expeditions.
4b. No refunds shall be made by Anderson Expeditions for any reason whatsoever, and neither will it accept any claims of any nature including consequential damages as a result of any accommodation or other facilities made or becoming unavailable on or prior to the expedition. The client hereby indemnifies and holds Anderson Expeditions harmless in respect of such or any claim.
4c. Anderson Expeditions reserves the right to cancel any tour without prior notification. In such event, all monies paid will be refunded in full, which shall constitute the full extent of Anderson Expeditions liability to the client.
5. BAGGAGE - (a) Each client is entitled to no more than one (1) suitcase of weighing no more than 20 kilograms. Anderson Expeditions may refuse to carry baggage in excess of the aforesaid. (b) All baggage and personal effects are at all times at the clients risk and Anderson Expeditions cannot accept any liability for any loss of or damage thereto.
6. AUTHORITY ON TOUR –
(a) The client acknowledges that Anderson Expeditions may appoint an expedition leader who shall be in charge of the expedition and all matters relating thereto, and the client agrees to comply with the expedition leaders' lawful requirements.
(b) The client must at all times comply strictly with the law, customs and foreign exchange regulations of all countries visited. (c) The client agrees to comply with Anderson Expeditions requirements with regard to his conduct and shall not in any way constitute a nuisance to any other persons on the expedition.
If any client acts in contravention of the above, Anderson Expeditions shall be entitled to terminate that clients participation on the tour without refund of any monies paid and without liability to Anderson Expeditions or its servants or agents. In these circumstances the client shall, at the clients expense and responsibility, be obliged to make his own way home.
7. TRAVEL DOCUMENTS - The client is responsible for ensuring that all necessary documents, passports, visas, health and other certificates and travel documents are valid and effective.
8. INSURANCE - Travel, medical expenses and evacuation, baggage, money and cancellation insurance is compulsory on all Anderson Expeditions trips. The client accepts that it is their responsibility to arrange their own insurance. It is advised that comprehensive “cancel for any reason” insurance is purchased on payment of the deposit, covering the client in the event of any cancellation or curtailment. Please note: insurers typically require this cover being in place within 10 days of the deposit payment being made.
9. FORCE MAJEURE - During the course of a tour, weather, road conditions, mechanical breakdowns and incidents beyond the control of Anderson Expeditions can influence the performance of an expedition. In the unforeseen event of any of these aforementioned events occurring, personal expenses, meals, alternative accommodation and all other resulting costs, including the cost of flying home, are to be borne by the client.
10. PHOTOGRAPHY - Anderson Expeditions reserves the right to make use, without giving any further notice, of any photograph or film produced by Anderson Expeditions during the expedition without payment or permission.
11. HEALTH - The client acknowledges being aware of the proposed itinerary and that the tour requires a certain level of physical fitness and acknowledges that he is medically fit and able to embark upon the expedition.
12. LIABILITY - Note: For the purposes of this clause, the definition of Anderson Expeditions shall include all member(s), employees and agents of Anderson Expeditions
(a) Anderson Expeditions shall have no liability whatsoever for any loss, including financial loss, arising from loss of and/or damage to any property of any CLIENT, nor for loss of any nature, including financial loss, arising from the death or injury of any CLIENT, howsoever any such loss, financial loss, damage, injury or death shall arise, including negligence of any degree on the part of Anderson Expeditions. The CLIENT hereby indemnifies Anderson Expeditions against all claims of whatever nature brought against Anderson Expeditions by the CLIENT, the CLIENT’S estate, or family of the CLIENT, including dependants, in respect of any personal injury, death, damage, or loss, including financial loss, of any nature howsoever caused, including negligence of any degree.
In making payment on the above invoice to Anderson Expeditions, I confirm I have read, fully understand and accept the booking terms and conditions. I further indemnify Anderson Expeditions, its member(s), employees and agents against any liability whatsoever, however arising, and understand that I undertake the expedition entirely at my own risk.
James Hendry Terms and Conditions
SPECIAL COVID-19 TERMS and CONDITIONS
These special terms and conditions are updated regularly and remain in place as an addition to my standard terms and conditions (refer below). They are valid until such time as the relevant travel restrictions (both outbound and for countries within which James Hendry operates) are lifted, after which only our standard terms and conditions apply.
James Hendry (JH) is subject to the specific terms and conditions of each operator (“our partners”) but endeavors to extend, in consultation with our partners, the following terms to our clients:
Postponements and cancellations:
- Should guests elect to cancel their booking, then JH standard terms and conditions will apply
- Should guests wish to postpone their booking for a COVID-19 reason (see definition below),
they can only do so:
o 6 weeks prior to the original date of travel
o And to a new date within 12 months of the original travel date (subject to availability)
- JH will communicate specific details about the postponed booking directly to each client. The kinds of details that will be communicated by JH will deal with, amongst other things, the following in relation to each guests’ specific itinerary:
o The booking value to be carried forward to the new dates. Credit already received by JH and our partners will be subject to partner/supplier administration, postponement and other fees they indicate at the time of postponement
o The cost increases on accommodation, services, logistics, activities etc. as a result of annual or seasonal or other rate changes
o JH will manage a postponed booking on behalf of the client free of charge on the first date change. Subsequent postponements or date changes will be charged at a fee of 10% on the total booking value.
We continue to engage with our partners to align with the Covid-19 James Hendry Special Terms and Conditions, and to work in our clients’ best interests as far as possible.

• For the purposes of these special terms and conditions a COVID-19 reason means:
The country of origin’s borders are closed, due to Covid-19 or the government of the travel destination(s) country(ies) institutes entry restrictions such as closed borders due to Covid- 19.

7. TRAVEL DOCUMENTS - The client is responsible for ensuring that all necessary documents, passports, visas, health, Covid-19 test certificates or vaccination documents etc, and other certificates and travel documents are valid and effective.
8. INSURANCE - Travel, medical expenses and evacuation, baggage, money and cancellation insurance is compulsory on all James Hendry trips. The client accepts that it is their responsibility to arrange their own insurance. It is advised that comprehensive “cancel for any reason” insurance is purchased on payment of the deposit, covering the client in the event of any cancellation or curtailment. The client hereby indemnifies James Hendry against all claims of whatever nature brought against James Hendry by the client, the client’s estate, or family of the client, including dependants, in respect of any personal injury, death, damage, or loss, including financial loss, of any nature howsoever caused, including negligence of any degree.
IN MAKING PAYMENT ON THE ABOVE INVOICE TO JAMES HENDRY, I CONFIRM I HAVE READ, FULLY UNDERSTAND AND ACCEPT THE BOOKING TERMS AND CONDITIONS. I FURTHER INDEMNIFY JAMES HENDRY, ITS MEMBER(S), EMPLOYEES AND AGENTS AGAINST ANY LIABILITY WHATSOEVER, HOWEVER ARISING, AND UNDERSTAND THAT I UNDERTAKE THE EXPEDITION ENTIRELY AT MY OWN RISK.
