Topguides Safaris Terms and Conditions
TOPGUIDES SAFARIS PAYMENT AND CANCELLATION POLICIES FOR FITs
GENERAL PAYMENT TERMS.
Deposit is due upon confirmation to secure the booking.
The full amount of the tour is payable not less than 60 days prior to the date when the tour commences. A booking made less than 60 days before the commencement of the tour is payable in full on confirmation of the booking.
An invoice issued by Topguides Safaris serves as final confirmation of the booking.
By confirming the booking, the client accepts that the tour carries inherent risks and assumes all risks which are associated with the tour. All Clients will be required to sign indemnities at the various camps/lodges/service providers and abide by the Operators Code of Conduct in order to ensure their safety.
In the event that a booking is not paid in full as per the above payment terms the Company reserves the right to refuse the Client(s) participation in the tour, the client will be liable for full cancellation fees.
TGS will not provide tickets, coupons, vouchers or booking documentation until proof of the full payment has been received.
We would prefer Wire transfer as a method of Payment.
Credit Card payments can be done through PesaPal link and will incur 3.5% surcharge.
CLIENT / TRAVELER RESPONSIBITY PRIOR AND DURING TRAVEL.
- Topguides Safaris will not be held liable for any delay, costs incurred or any other inconvenience caused, if you are denied entry into a country due to incorrect documents or inoculations. It is the responsibility of each Client/Traveler to ensure they have the necessary visas that may be required in respect of the proposed Tour and final confirmed itinerary for the relevant African and Indian Ocean countries, this includes all transit points. Topguides Safaris does NOT offer a visa service.
- The Client / Traveler is responsible to ensure that they are in possession of necessary health, requirements and certificates that may be required for travel to countries on their Confirmed itinerary.
- Consult your doctor on malaria medication or speak to your local travel clinic. Yellow fever inoculations are compulsory for East Africa and we recommend you take the additional following inoculations for Typhoid Fever, Hepatitis A&B Cholera and Meningitis.
- It is the Client / Traveler responsibility to communicate any flight changes or cancelations to Topguides Safaris in writing by email.
- It is the Client / Traveler responsibility to take out comprehensive travel insurance to covering them for personal effects, personal accident, medical and emergency travel expenses for this non-refundable deposit.
- The deposits are non-refundable. The Client / Traveler needs to take out travel insurance to cover this deposit as soon as the deposit is paid. Topguides Safaris will not be held responsible for this non-refundable deposit.
- The Client / Traveler is sorely responsible for ensuring that all payments due to TGS are received timeously by TGS in accordance with provisions of terms and conditions.
- It is the Clients/ Travelers responsibility to print a copy of the final confirmed itinerary and any relevant documents to this Final Confirmed Itinerary.
- That neither TGS, its holding, parent company or representatives shall be liable for any loss, injury death or damages arising from the Final Confirmed Itinerary. The Client / Traveler hereby irrevocably and unconditionally agrees that he/she is taking the Final Confirmed itinerary at his/her own risk.
- Safekeeping of baggage and personal effects shall at all times remain the Client / Travelers risk. TGS will assume no liability for lost or damaged luggage or personal effects during the Final Confirmed Itinerary.
ALTERATIONS OF SERVICES.
- Topguides Safaris cannot guarantee the following and is not liable or responsible for Fuel surcharge increases, increase in entrance fees, government, regional levies and taxes etc. Airfares are subject to the prices and conditions quoted by the airlines and cannot be guaranteed by TGS until full payment is received by Client / Traveler and tickets issued.
- Topguides Safaris is not responsible for any changes due to personal circumstances , delays , changes and omissions before or during your Final Confirmed Itinerary due to technical difficulties , adverse weather conditions , communication breakdowns , events including but not limited to unscheduled extensions or curtailment of accommodation , changes to scheduled flights , additional airfares , telephone and meal costs etc. will be for the clients own account.
- Topguides Safaris is not responsible for any cancelation or curtailment of the Tour as a result of the Client or travelers’ personal circumstances e.g. death, illness.
- Private or scheduled charter flights - Topguides Safaris or the charter company do not accept any responsibility for delays, cancellations due to unforeseen circumstances, technical breakdowns, diversions due to bad weather or airline liquidations.
- Topguides Safaris and all suppliers are not responsible should the any government or countries issue travel restrictions or bands on travel which will affect the Final Confirmed Itinerary.
FORCE MAJEURE.
- Force Majeure means in relation to Topguides Safaris and relevant suppliers any circumstances beyond the reasonable control of Topguides Safaris. Including but without limitation acts of God, explosion, flood, tempest, fire, accident, war, threat of war, strike, sabotage, insurrection, civil disturbances or requisition, sickness, quarantine, government intervention (i.e., closing of borders, travel bands) weather conditions, lack of materials, renovations or other unexpected occurrences.
CANCELATTION POLICY.
All cancellations should be made in writing and will only be deemed effective upon acknowledged receipt by Topguides Safaris.
Cancellations will be subject to the following penalties:
- 30% nonrefundable deposit due upon booking confirmation.
- 100% penalty of the full amount due will apply for cancellation 60 days or less prior to arrival date.
Normal cancellation fees apply if you wish to postpone your departure. Date changes will be treated on an individual basis and will attract an administration fee of $50 per person.
- Once the final Confirmed Itinerary date has commenced, refunds will not be made for voluntarily missed tours, meals cancelled, no show at accommodation, no show on flights or any other travel related activities or service confirmed on your tour.
Payment terms for booking Kenyan Tours and properties applied to agents, tour operators and FITs.
- 50% non-refundable deposit is due upon confirmation of the booking for selected properties.
- 50% balance is due 60 days prior to arrival date.
Payment terms for booking Gorilla Trekking and properties in Uganda applied to agents, tour operators and FITs.
- 100% nonrefundable payment is due to secure Gorilla Trekking and other permits.
- 25% nonrefundable deposit is due for the rest of the items on the itinerary upon confirmation of the booking.
- General cancellation penalties apply.
PAYING INVOICES.
- If you receive any notification via email or any other correspondence advising of any banking charges for Agents / Tour Operators, it is your responsibility to check prior to payment with Agents / Tour Operators that this information is correct.
- Topguides Safaris will not be responsible if you pay your deposit or final payment into incorrect bank account.
