Additional remarks:-
- We may have to reroute the itinerary or accommodate in similar lodges in case of
Non-availability.
- Prices for domestic flights, airport taxes or park fees may be changed without prior
notice. This is beyond our control and any increase levied will be passed to you.
Passenger Information :-
- Passengers should bring only soft sided bags on safaris
- All the passengers must have Identification Card/Passport with them for internal flights
- Baggage on internal flights is strictly limited to 15 kgs per person (including hand luggage).
- Any excess baggage will be charged by the airline at check-in.
- Passengers arriving to Kenya and Tanzania may be asked to present a valid Yellow
-Fever Vaccination Certificate.
The price quoted and services will be subject change depending on availability at the time of booking.

TERMS AND CONDITIONS
PRICES
Prices quoted include all expenses in connection with a vehicle, driver guide, domestic flight, hotel accommodation, Government taxes and levies and park fees (except where specified otherwise) where applicable. Any entry visas, inoculations, personal travel insurance, tips/gratuities or other items of a personal nature are not included.
Government taxes and levies and park fees may be changed without prior notice. This is beyond our control and the additional cost will be passed to the client.
PAYMENT
Deposit - 30% of the total booking value is payable at the time of booking. This deposit allows us to pay deposits to suppliers including hotels, camps, lodges and airlines.
Balance – 70% of the total booking value is payable 60 days prior to the departure date.
A booking is considered confirmed once we have received the deposit and issued a confirmation voucher. If payment is not received by the due date Hemingways Expeditions reserves the right to treat the booking as cancelled and apply the cancellation charges detailed in the paragraph below.
CANCELLATION TERMS
In case of cancellation, any refund of an amount paid will be subject to the following cancellation charges. The charges are based on the cancellation policies of suppliers. We try to keep cancellation charges to a minimum for our clients and will always try to avoid cancellation charges where possible particularly if a cancellation is out of the client’s control.
- 61 days before departure date, the cancellation charge will be 10% of the total booking value
- 60 - 35 days before departure date, the cancellation charge will be 25% of the total booking value
- 34 - 20 days before departure date, the cancellation charge will be 50% of the total booking value
- Less than 20 days before departure date, the cancellation charge will be 100% of the total booking value
Unless in particular instances of dissatisfaction, no refund will be given for guests who choose to depart an itinerary before the scheduled end date.
REFUND TERMS
Refunds offered will be as per the above cancellation terms and will be paid net of bank/payment transaction/ currency exchange charges.
CHANGES AND ALTERATIONS
Should you wish to make changes to a confirmed itinerary, we will be happy to assist. Note, however, that additional charges may apply.
Hemingways Expeditions reserves the right to cancel or make changes to itineraries before and after an itinerary has been confirmed. Any changes are likely to be minor but should circumstances or events make it necessary for us to change an itinerary, a suitable alternative will be offered or, if applicable, a refund will be given.
DATA PROTECTION
Both Parties will comply with all applicable requirements of the Kenya Data Protection Act, 2019 and the regulations promulgated under it from time to time (together, the Data Protection Legislation). This Clause is in addition to, and does not relieve, remove or replace, a party’s obligations or rights under the Data Protection Legislation.
Each party acknowledges that the Agent will regularly disclose personal data relating to guests including name, date of birth, passport/identification information, guest preferences and billing instructions to Hemingways Expeditions (Shared Personal Data) for purposes of organizing travel and tours and making reservations (the Agreed Purpose).
Each party shall comply with all the obligations imposed on a controller under the Data Protection Legislation, and any material breach of the Data Protection Legislation by one party shall, if not remedied within 30 days of written notice from the other party, give grounds to the other party to terminate this Agreement with immediate effect.
Each party shall:
ensure that it has all necessary notices and consents and lawful bases in place to enable lawful transfer of the Shared Personal Data to the Permitted Recipients (as defined below) for the Agreed Purpose;
give full information to any data subject whose personal data may be processed under this Agreement of the nature of such processing. This includes giving notice that, on the termination of this Agreement, personal data relating to them may be retained by or, as the case may be, transferred to one or more of the Permitted Recipients, their successors and assignees;
process the Shared Personal Data only for the Agreed Purpose;
not disclose or allow access to the Shared Personal Data to anyone other than the parties to this Agreement, the employees of each party, and any third parties engaged to perform obligations in connection with this Agreement (Permitted Recipients);
ensure that all Permitted Recipients are subject to written contractual obligations concerning the Shared Personal Data (including obligations of confidentiality) which are no less onerous than those imposed by this Agreement; and
ensure that it has in place appropriate technical and organisational measures, reviewed and approved by the other party, to protect against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.
Each party shall assist the other in complying with all applicable requirements of the Data Protection Legislation. In particular, each party shall:
consult with the other party about any notices given to data subjects in relation to the Shared Personal Data;
promptly inform the other party about the receipt of any data subject rights request;
provide the other party with reasonable assistance in complying with any data subject rights request;
not disclose release, amend, delete or block any Shared Personal Data in response to a data subject rights request without first consulting the other party wherever possible;
assist the other party, at the cost of the other party, in responding to any request from a data subject and in ensuring compliance with its obligations under the Data Protection Legislation with respect to security, personal data breach notifications, data protection impact assessments and consultations with the Data Commissioner or other regulators;
notify the other party without undue delay on becoming aware of any breach of the Data Protection Legislation;
provide the other party with contact details of at least one employee as point of contact and responsible manager for all issues arising out of the Data Protection Legislation, including the joint training of relevant staff, the procedures to be followed in the event of a data security breach, and the regular review of the parties' compliance with the Data Protection Legislation.
FORCE MAJEURE
Hemingways Expeditions is not liable for acts of God, fire, weather, acts of Governments or other authorities, wars, civil disturbances, riots, terrorist acts, strikes, pandemics and other similar acts beyond its control.
LIABILITY
Hemingways Expeditions’ liability to clients transported in its own vehicles will be governed by the laws of the country in which the action resulting in a liability claim takes place. Travel carries some measure of inherent risk including, but not limited to, the hazards of travelling in underdeveloped areas where road conditions and other facilities may be poor or lacking; the forces of nature; and accident or illness in remote regions without means of rapid evacuation. Bookings are accepted on the specific condition that Hemingways Expeditions acts only as agents of the passenger in all matters relating to hotels, sightseeing tours, restaurants, all forms of transportation and other services which may be included in these tours. Hemingways Expeditions purchases these services from suppliers and other independent contractors without warranties and representations from them and thus such services are not subject to its control. The right is reserved to substitute hotels of comparable status and to make any changes in the itinerary where deemed necessary or caused as a result of adverse road or weather conditions, disruptions to airline schedules or any other valid reason.
While all precautions are taken to ensure the passenger's safety and enjoyment on these tours, Hemingways Expeditions and/or its agents shall not be liable for death, injury, delay, loss or damage arising from any cause and in any manner whatsoever or change of itinerary or act, including any acts of terrorism, acts of God and government, neglect, accident, error or omission caused by any of these suppliers or independent contractors, their employees, representatives or any event beyond the control of Hemingways Expeditions. All baggage is carried at the passenger's own risk, and Hemingways Expeditions reserves the right to exclude certain baggage at its discretion. The airlines used to provide flights within Kenya are subject to international air conventions limiting its liability; the limitations of liability are contained on the reverse side of the airline ticket and form part of the terms and conditions of this package.
Except where Hemingways Expeditions provides their own vehicles for the transportation of clients, the suppliers and their agents act only as agents of the client in all matters relating to hotel accommodation, tours and transport, whether by aircraft, rail, road, ship or any other means – and shall not be liable for any failure to perform, injury, delay, loss or damage arising from or in connection with the provision of such services, save where such failure, injury, delay, loss or damage is caused by the negligence of the suppliers.
COMPLAINTS HANDLING
We very much hope that all our clients have a highly enjoyable safari. However, should customers experience problems kindly notify us immediately so we can find a suitable solution. In the event a client remains dissatisfied, we would request complaints to be sent to us in writing within 15 days of the end of the safari.
TRAVEL INSURANCE
We strongly recommend our clients to buy travel insurance to protect them from any unforeseen circumstances while travelling. This should include insurance relating to Covid 19 disruption.
If you require assistance with purchasing travel insurance, please advise your Travel Consultant.
Hemingways Expeditions shall not be held liable in any way whatsoever should you fail to purchase adequate travel insurance. We request that you provide us with your insurance provider’s name, together with the policy number and the insurance company’s emergency contact telephone number in case of any emergency whilst you are traveling.
KEY INFORMATION
Travellers should travel with soft sided bags and the usual luggage allowance on domestic safari flights is 15kg per person including hand luggage. If you require additional luggage for your trip, we can arrange storage and/or shipping at an additional cost.
All travellers must travel with a valid Identification Card/Passport.
Please check current health entry requirements for your country of arrival. We can provide advice if required.
OPTIONAL ACTIVITIES
At some of the places you will visit on your tour, optional activities will be available from other independent suppliers who are not affiliated with Hemingways Expeditions. Some of these activities carry with them inherent risks, including that of attack by wild animals, which can cause serious injury. These activities include, but are not limited to, (1) walking safaris; (2) horseback/camel safaris; (3) canoeing; (4) hot air balloons; (5) gorilla trekking; (6) underwater diving and snorkeling; You should be aware that, although precautions are taken by the suppliers to guard against such dangers, your safety cannot be guaranteed. Should you elect to participate in such activities while you are on your tour, you are free to do so. However, such participation will be at your own risk. Hemingways Expeditions assumes no responsibility for your safety. Hemingways Expeditions requests common sense and caution be exercised while visiting any of the cities and towns on the tour. The company is in no way responsible for incidents or personal/public interaction occurring between a tour member and anyone you may meet while on tour.
