GET AFRICA AS TERMS & CONDITIONS
- DEFINITIONS
In these Terms & Conditions, unless inconsistent with the context, the following words and expressions shall bear the meanings assigned thereto and cognate words and expressions shall bear the corresponding meaning:
- Get Africa AS: with registered address Ospeveien 35, 4622 Kristiansand, Norway, and duly registered in terms of the laws of Norway with Org.nummer 989 514 199.
- Traveller: Any natural person, either jointly or severally, who enquires about specific Travel Services and/or books such Travel Services and for who the Travel Services have been arranged.
- Travel Services: travel arrangements, including those supplied by third-party service providers and suppliers, including but not limited to accommodation, car hire, transfers, private guiding, meet & greet services, excursions, activities, conferences, events, and flights.
- Final Offer: the quotation and itinerary for Travel Services prepared by Get Africa AS for the Traveller and accepted by the Traveller.
- Business Day: Monday to Friday, excluding gazetted Norwegian public holidays (https://lovdata.no/dokument/NL/lov/1995-02-24-12)
- PREAMBLE
- Get Africa AS is a professional tour operator arranging Travel Services for and on behalf of Travellers in Africa. Get Africa AS acts for itself and on behalf of its third-party suppliers which are governed by rules and regulations stipulated in their respective country of operation.
- Get Africa AS is a member of Reisegarantifondet and follows Pakkereiseloven.
- PERTINENCE
These Terms & Conditions apply to all enquiries for and bookings of Travel Services by a Traveller directly with Get Africa AS. These General Terms & Conditions do not apply to agent bookings. Only if Get Africa AS has agreed to conditions that divert from the below explicitly in writing, such explicit conditions will prevail. It is the responsibility of the Traveller to ensure that all persons travelling together with the Traveller are aware that these Terms & Conditions apply to their Travel Services and Final Offer.
- BOOKING PROCEDURE
- Any provisional bookings for Travel Services are held for a limited period, usually between 7-14 days, depending on the supplier. Thereafter Travel Services will become subject to availability.
- Prior to acceptance of an offer, the Traveller will review the details of each travel segment of the itinerary for accuracy, and inform Get Africa AS of any discrepancies, errors or services that the agent wishes to omit or add.
- On acceptance of the Final Offer, the agent must confirm the itinerary in writing to Get Africa AS by return email to the address from which the offer was received. Simultaneously, the Traveller must provide Get Africa AS with a copy of the valid passport of each traveller, clearly showing the relevant information: full names, nationality, passport numbers, date of birth.
- Prior to confirmation of an itinerary, prices may be subject to change and services subject to availability.
- Once an itinerary is confirmed, prices may remain subject to change due to government increases (park fees, taxes), fuel increases, rate of exchange fluctuations, and other increases beyond Get Africa AS’ control. In such event, Get Africa AS will do its utmost to minimize the disruption of the itinerary and additional charges, however any costs incurred in relation thereto will be borne by the Traveller.
- AMENDMENTS TO CONFIRMED BOOKINGS
- Any changes to the Final Offer by the Traveller will incur a change fee, which will be determined by Get Africa AS depending on the type of itinerary and type of amendment.
- Get Africa AS reserves the right to change the itinerary, transport and accommodation of a Final Offer if conditions such as fire, natural disasters, third-party supplier circumstances, etcetera force such a change.
- INVOICING & TERMS OF PAYMENT
- The Final Offer will be invoiced once Get Africa AS has received confirmation from all relevant third-party suppliers, such as hotels, lodges, and other service providers.
- In general, itineraries are invoiced and payable in Norwegian Krone for services in South Africa and Namibia, and in United States Dollars for services in other parts of Southern Africa, East Africa and the Indian Ocean Islands. If agreed between parties, Get Africa AS will invoice itineraries in an alternative currency as appropriate.
- The Payment terms below apply to the total price of the Travel Services, except for flight tickets which are payable in full on issue, and if a third-party supplier stipulates stricter payment terms.
- For Travel Services confirmed and invoiced by Get Africa AS at more than 90 days prior to travel:
- 25% non-refundable deposit payment is required on confirmation of booking and payable within 7 days of receipt of the Get Africa AS invoice.
- 75% balance payment must be received by Get Africa AS no later than 45 days prior to the departure date of the itinerary.
- For Travel Services confirmed and invoiced at 90 days or less prior to travel, the Get Africa AS invoice is payable in full within 7 days of receipt thereof.
- For Travel Services confirmed and invoiced by Get Africa AS at more than 90 days prior to travel:
- Proof of payment must be sent to info@getafricatravel.com.
- Late payment may result in release of services.
- Any amendments after confirmation and invoicing may require an additional deposit payment.
- Any waiver of deposit payment or diversion of the terms of payment does not waive cancellation policies relevant to the itinerary.
- To safeguard against cyberfraud and consequences thereof, it is the Traveller’s responsibility to verify the banking details of Get Africa AS before remitting payment.
- PAYMENT VIA CREDIT CARD
- Payment by credit card will incur a transactional surcharge of maximum 3.25%, depending on the card type used to process payment.
- Get Africa AS accepts MasterCard, Visa, American Express and Diners.
- Get Africa AS will only use the Traveller’s credit card details in relation to the itinerary and shall never sell or pass on these details to a third party.
- Get Africa AS may only collect funds via credit card in Norwegian Krone, not in a different currency. Funds will be debited from the payer’s account at the rate of exchange on the date of invoice.
- CANCELLATIONS
- The cancellation terms below apply to the total booking price.
- Cancellation of any service booked with Get Africa must be communicated in writing via email to info@getafricatravel.com. Communications received on a Business Day between 00h00 and 16h00 Norwegian time will be considered to have been received on that day. Communications received outside these times, will be considered to have been received the following Business Day.
- This cancellation policy applies to all reservations, except for airline tickets which have individual cancellation policies. This cancellation policy applies regardless of whether payment to the value of the cancellation fee has been received.
- 25% cancellation fee: 61+ days before departure of trip
- 50% cancellation fee: 60-46 days before departure of trip
- 100% cancellation fee: 45 days or less before departure of trip
- No refunds are offered for missed excursions, activities, no-shows, early check-outs.
- Stricter policies may be imposed by a supplier to Get Africa AS, which will apply to the Traveller. In that case, Get Africa AS will inform the Traveller and do its utmost to minimise an increase in cancellation fees.
- In the event a refund is due, all banking charges will be for the account of the Traveller.
- RESPONSIBILITY OF THE TRAVELLER
- It is the responsibility of the Traveller to take out adequate travel insurance when Get Africa AS issues the invoice for the Final Offer. Comprehensive travel insurance is essential for every Traveller’s protection against cost of cancellations by the Traveller, Get Africa AS Travel, or a third-party supplier for unforeseeable circumstances. If a Traveller has chosen not to take out insurance or has taken out inadequate insurance, Get Africa AS is under no obligation to negotiate any refund or credit on behalf of the Traveller.
- Passports must be valid for at least 6 months beyond the intended departure date of travel and have at least 2 consecutive blank visa pages per country included in the Travel Services. If these requirements are not met, the Traveller could be denied entry or exit at time of travel.
- Compliance with any visa requirements and all costs related to visas are the responsibility of the Traveller.
- The Traveller must carry proof of relevant inoculations as required by the countries included in the Travel Services and ensure that he/ she/ they is/ are medically fit to travel.
- It is the responsibility of the Traveller to familiarise himself/ herself / themselves and comply with luggage limitations and specificiations for air travel and the luggage capacity of any car rental group booked. Road transfer arrangements are booked based on Travellers travelling with one (1) suitcase and up to two (2) pieces of hand luggage. In the event that Travellers will be travelling with additional luggage, this must be communicated to Get Africa AS prior to travel. Additional charges for increased luggage capacity may apply.
- PERSONAL INFORMATION
Get Africa AS will never sell or pass on your personal or sensitive information. Personal information will be distributed to the accommodation, car rental companies and other service providers relevant to the itinerary of the Traveller who require such details for the itinerary to be completed. Personal information will remain on file with Get Africa AS after the itinerary has ended, unless an instruction to delete any such information has been received by Get Africa AS from the Traveller.
- AMENDMENTS TO TERMS & CONDITIONS
Get Africa AS reserves the right to amend its terms and conditions at any time. Confirmed itineraries will not be affected by such amendments unless there are obstacles beyond Get Africa AS’ control.
- FORCE MAJEURE
Get Africa AS does not accept liability or pay any compensation, interest or damages to the Traveller where the performance or prompt performance of Get Africa AS’ obligations is prevented or affected by force majeure, or if the Traveller has suffered any damage, loss or expense of any nature as a result of force majeure.
- COMPLAINTS, DISPUTES & APPLICABLE LAW
- Any complaints related to Travel Services must be telephonically reported to Get Africa AS at the time of the incident and followed up in writing via email to info@getafricatravel.com no later than 30 days after the incident has occurred.
- Get Africa AS will acknowledge the complaint and endeavour to investigate it with the relevant service provider within a 30 day period after which it will provide you with written feedback.
- Although Get Africa AS will make every effort to assist in the resolution of the complaint, it cannot guarantee the satisfactory resolution of complaints for services and products outside of its control and for which it is not responsible.
- The Travel Services and these Terms & Conditions shall be governed by and construed in accordance with the Norwegian law, more specifically the regulations as covered in Lov om pakkereiser og reisegaranti mv. (pakkereiseloven). Any disputes in relation thereto that cannot be resolved between parties will be brought to the competent court in Norway.
